RevisionofArticle20ofAIAContractForm WeareindebtedtoB.L.Noblitt,ExecutiveSecretaryofSMERO RACCA,forcallingtoourattention arevisionofArticle20ofthe standardAIAcontractforconstruction.Thearticle,asrevised, readsasfollows: rrArt.20.CORRECTIONOFWORKAFTERFINALPAYMENT.The Contractorshallremedyanydefectsduetofaulty materialsor workmanshipandpayforanydamagetootherwork resultingtherefrom,whichshallappearwithinaperiod ofoneyearfromthedateoffinalpayment,orfromthe dateoftheOwner\'ssubstantialusageoroccupancyof theproject,whicheverisearlier,andin accordance withthetermsofanyspecialguaranteesprovidedinthe contract.NEITHERTHEFOREGOINGNORANYPROVISIONIN THECONTRACTDOCUMENTS,NORANYSPECIALGUARANTEETIME LIMIT,SHALLBEHELDTOLIMITTHECONTRACTOR\'SLIABILITY FORDEFECTS,TOLESSTHANTHELEGALLIMITOFLIABILITY INACCORDANCEWITHTHELAWOFTHEPLACEOFTHEBUILDING. TheOwnershallgivenoticeofobserveddefectswith reasonablepromptness.Allquestionsarisingunder thisArticleshallbedecidedbytheArchitectsubject toarbitration,notwithstandingfinalpayment. 11 Thesentenceincapshasbeenadded.Whiletheinterpretationof thisadditionisnotwithoutambiguity,it couldcertainly beconstruedtomeanthatthecontractorisliabletoremedyanydefects duetofaultymaterialsor workmanshipduringtheentireperiodof thestatuteoflimitations.Thestatuteoflimitationsoncontract obligationsvariesfromstatetostate,but wouldprobablybesomewherebetweentenandtwentyyears.Itisapparent,therefore,that thechangein Article20oftheAIAformcouldbeinterpreted asextendingtheroofingcontractor\'sguaranteeforthefullperiodof thestatuteoflimitationsinspiteofanyshorterperioddesignated inotherdocuments. Thisisaboobytrapyoushouldguardagainst.Iwouldappreciateit if any memberwhoisofferedacontractcontainingthe abovelanguagewouldcallit tomypersonalattention.'
