OSHA\'spresentpolicyistoc,iteeachemployerwhoseemployeesare actuallyorpotentiallyexposedtohazardousconditions,regardlessof whetherthehazardiscreatedbythatemployer.Anemployerisnotcited ifhisemployeesarenotactuallyorpotentiallyexposed.Inotherwords, thepresentpolicyisoneofresponsibilitybasedonexposure. Becauseofrecentcourtdecisions,principallythedecisionofthe SeventhCircuitCourtofAppealsin Anning-Johnson,OSHAhasbeenforced toreconsideritspresentpolicy. Theproposedguidelineisasfollows: A.Citationswouldbeissuedtotheemployerona multi-employerworksitewhocreatesorcauseshazardous conditionstowhichhisemployeesorthoseofanyother contractororsubcontractorengagedinactivitiesonthe multi-employerjobsiteareexposed.Inotherwords,OSHA wouldcitetheemployerdirectlyresponsibleforthehazard-ousworkingcondition.Toillustratetheapplicationofthis proposedguideline,OSHAprovidesthefollowingexample:A subcontractorwhohasimmediatecontroloverandresponsibility foranoperationalphaseofamulti-employerworksite,including theesponsibilityfortheerectionofguardrails,wouldbe r5001citedunder1926.(d)(),regardlessofwhetherhisemployees\\-,-areactuallyorpotentiallyexposedtothehazardousworking condition,ifanyemployeesofanotheremployer,engagedin worksiteactivityareexposedtothehazard.Theproposed guidelinesdonotfurnishguidanceastohowOSHAwilldeter-minewhichsubcontractorhas"immediatecontroloverand responsibilityforerectionofguardrails."Underitspresent policy,OSHAhasignoredresponsibilitydesignationsinthe contractdocuments.However,undertheproposedguidelines, OSHAmaywelllooktothecontractdocumentstodeterminewhich employerhascontractualresponsibilityforerectionofguard-rails.Accordingly,inyourcontractwiththegeneralcontractor, includeaclausestatingthatthegeneralcontractorhasresponsi-bilityforerectionofguardrails. B.Undertheproposedguidelines,OSHAwillalsocite theemployerwhohastheabilitytoabatethehazardous conditionregardlessofwhetherhecreatedthehazardin thefirstinstance.Indeterminingabilitytoeffectuate abatement,OSHAwillconsiderwhethertheemployerhas controlovertheworkers,materialandequipmentnecessary toabatethehazardorhastheauthoritytoorderabatement ofthehazardcreatedbyanotheremployer. c.Finally,astoviolationswhicharereadilyapparent, OSHAwillcitenotonlytheemployerwhocontrolsorisresponsibleforthehazards,butalsotheemployerwhopermitshis employeestobeexposedtothehazardousconditions,regardless'
