b'Thedecisionmaybelittle morethanasymbolicvictoryforMr.Barlow andallemployerssubjecttopossibleinspectionbyOSHA.TheCourtheld thatanOSHAinspector\'sentitlementtoasearchwarrantwillnotdepend onhisdemonstratingprobablecausetobelievethatconditionsinviolationofOSHAexistonthepremiseshewishestoinspect.Quotingfrom theCourt\'sdecision: "Awarrantshowingthataspecificbusinesshasbeenchosen foranOSHAsearchonthebasisofageneraladministrative planfortheenforcementoftheActderivedfromneutral sourcessuchas,forexample,dispersionofemployeesin varioustypesofindustriesacrossagivenarea,andthe desiredfrequencyofsearchesofanyofthelesserdivisions ofthearea,wouldprotectanemployer\'sFourthAmendment rights." Inotherwords,asearchwarrantwillbelittle morethanaformality andapaperwork/administrativeburdentoOSHA.OSHAshouldhaveno difficultyobtaininganyandallofthesearchwarrantsit desiresbecauseit willnotbeputtotheburdenofdemonstratingprobablecause tobelievethattheemployertobeinspectedisinviolationofOSHA. Intheabsenceofawarrant,youmayrefuseadmissionofanOSHA complianceofficertoanyportionofyourbusinesspremiseswhichisnot opentothepublic.Forthispurpose,yourbusinesspremiseswould includenotonlyyourshopbutalsothosejobsitelocationsoverwhich youhaveresponsibilityandcontrol. Youmay,ofcourse,allowanOSHAinspectortoinspectyourbusiness premisesintheabsenceofawarrant.However,shouldyouinsistupon thewarrant,and,upontheassumptionthatthecomplianceofficerdoes nothaveawarrantatthetimeofhisinitialinspectionrequest,you willbeabletodelaytheinspectionuntilheobtainsthewarrant, therebyeliminatingtosomedegreethepresentsurpriseelementofOSHA inspections.Itcanbepredictedwithsomeassurance,however,thatif therearewholesalerefusalsbyemployerstopermitinspectionsinthe absenceofwarrants,OSHAwillobtainwarrantsinadvanceoftheinitial inspectionrequestasamatterofroutine.
