Withrespecttohealthinsurance,therevisedInterpretiveBulletin specifiesvariousrequirementswithrespecttothoseofyouremployees eligibleforMedicare.Yourplanmay11 carve-out"Medicarebenefitsso thatMedicareassumesprimaryresponsibilityforhealthcareexpenses underyourolanwithyourplanpayingonlythoseexpensesit insures against whicharenotactuallypaidforbyMedicare.Youmaynotassume thatyouremployeeseligibleforMedicarehavetakenadvantageofavailableMedicarecoverageunlessyouinformsuchemployeesoftheneedto applyforMedicurecoverageandprovidethemwithanynecessaryassistancein makingapplicationforbenefits.Further,youmayh avesome obligationtopaypartorall of youreligibleemployeesMedicare"Part B"coveragecost. TherevisedInterpretiveBulletinalsospecifiesvariousrequirements withrespecttodefinedcontributionanddefinedbenefitretirem ntplans._/ e2.PregnancyBenefits.ThePregnancyDiscriminationActof1978 amendsTitleVIIoftheCivilRightsActof 1964tomakeit clearthat TitleVIIprohibitsdiscriminationinemploymentagainst womenaffected bypregnancyorrelatedconditions.Intheareaoffringebenefits, suchasdisabilitybenefits,sickleaveandhealthinsurance,women unabletoworkforpregnancy-relatedreasonsareentitledtodisability benefitsorsickleaveonthesamebasisasemployeesunabletowork forothermedicalreasonsandanyhealthinsuranceprovidedmustcover expensesforpregnancy-relatedconditionsonthesameb asisasexpenses forother medicalconditions. Forexample,it hasbeenafrequentpracticeinhealthinsurance planstoimposeawaitingperiod(normallyninemonths)withrespectto eligibilityforpregnancybenefitcoverageofnewemployeesandt heir dependents.Unlesstheplanimposesasimilarwaitingperiodwith respectto coverageforallbenefits,thepregnancycoveragewaiting periodmustbeeliminated.Sickpayanddisabilityplansfrequently containpregnancyexclusions.Suchexclusionsmustbeeliminated. Werecommendthatyoucheckwithyourplanadvisorstodetermineif planchangesareneededtoconformtothenewagediscriminationand pregnancybenefitrequirements.'
